Canada: Islamic Veil Allowed in Legal Hearing

W300

A judge cannot refuse to take testimony from a woman because she is wearing an Islamic veil, a court has ruled.

A citizen may wear any religious attire in a courtroom so long as their "religious beliefs are sincere" and they do not "conflict with another person's constitutional rights," the Quebec Court of Appeal ruled unanimously.

Montrealer Rania El-Alloul, a Muslim, was expelled from a courtroom in 2015 for wearing a hijab.

Judge Eliana Marengo of the Court of Quebec had cited a court ruling that every person must be "appropriately dressed" and compared El-Alloul's headscarf "to a hat or sunglasses."

But Marengo did not take into account the right of El-Alloul "to religious expression," the three appeals judges ruled.

Nowhere in the Holy Koran does it state that a woman has to wear a head covering, so who exactly brought this into being and to make it a religious expression?

Actually phillipo, being a muslim, it is an absolute requirement by the Quran to follow the Quran AND the Teachings of our prophet (wearing of the head scarf for example is a teaching <hadith> of our prophet sws). since the Quran says in many instances to follow our prophet’s teachings the Quran validates the headscarf teaching... Mohamed (sws) was guided by Allah (swt) as Jesus (as) and all the messengers before them.

...Our Lord! we believe in what Thou hast revealed and we follow the apostle, so write us down with those who bear witness... quran:3/200. Many other instances in the quran were Allah (swt) tells us to listen to our prophet...
